How to buy a property on the Costa del Sol – step by step
Buying property in Spain follows a clear, well-established procedure. The sale is completed before a notary, and the property’s legal status is checked at the Land Registry.
Here are the main stages of the purchase.
1️⃣ Choosing a property
We help you find an apartment or house that suits your needs – both for living and as a rental investment.
2️⃣ Property reservation
Once you have chosen a property, you sign a reservation agreement and pay a reservation deposit to take it off the market.
3️⃣ Checking the legal status
The lawyer checks the property in the Registry (Registro de la Propiedad), including any encumbrances, debts or mortgages.
4️⃣ Preliminary contract
A purchase agreement (Contrato de Arras) is signed and the buyer usually pays around 10% of the property value.
5️⃣ Notarial deed
The title deed (escritura) is signed before a Spanish notary. The deed is then registered at the Land Registry.
6️⃣ Key collection
On completion, the new owner receives the keys.
Costs of purchasing a property in Spain
On top of the price, you need to budget for the costs of the purchase itself.
As a guide, they come to around 9–11% of the price for a resale property and 12–13% for a new build, and include:
• purchase taxes (ITP on resales; IVA and stamp duty on new builds)
• notary fees
